Terms, Conditions and Liability Waiver Agreement

I have decided and agreed to take part in the Beijing 2008 Summer Program offered by the Hutong Group Limited and Beijing Yanjing Wenhua Zhuanke Xuexiao (hereafter "Beijing Yanjing School") in cooperation with Beijing Guangbo Dianshi Daxue (hereafter “BTVU”).

I acknowledge that I have been advised regarding the full scope of activities associated with the program as stated on the website or program materials, including classes, visits and trips, living conditions and other logistical arrangements.

In consideration of this opportunity to participate in the Beijing 2008 Summer Program, I do voluntarily and without reservation, release and hold harmless, and indemnify the Hutong Group Limited/Beijing Yanjing School and BTVU including its program directors and other employees there of from any liability, claims, demands, and causes of actions arising out of or related to any loss, damage, irregularity or expenses arising from any vehicle or services, strikes or war, weather, sickness, quarantine, government restrictions or regulations, or from any act of omission of any airline, bus transportation, any other mean of transportation, sightseeing, dormitory, hotel, or any other service transporting company, firm, individual or agency, or any staff member related to this study program.

I hereby grant the Cand its agents full authority to take whatever actions they may consider to be warranted due to any international or political unrest, personal emergency or other event regarding my health and safety, and I fully release each of them from any liability for such decisions or actions as may be taken in connection therewith.

The Hutong Group Limited/Beijing Yanjing School does not have control over any services offered by BTVU.

I give the Hutong Group Limited/Beijing Yanjing School and BTVU my permission to use for promotional purposes any photographs or movies taken in the course of my participation in the program.

In order for the Beijing 2008 Summer Program to take place the Hutong Group Limited/Beijing Yanjing School and BTVU require at least eight participants in each program. Hutong Group Limited/Beijing Yanjing School and BTVU reserve the right to cancel the Beijing 2008 Summer Program if the minimum number of participants is not reached.  
  
1. Respect of the internal rules and order of the program

I am aware of the behaviour that is expected of me while participating in the Beijing 2008 Summer Program.
 
I am aware that, as a visitor in a foreign country, there is certain inappropriate behaviour that will be unacceptable and such behaviour could lead to possible disruption of the program. I hereby assure that I shall conduct myself in an appropriate manner at all times. I agree that the Program shall have the right to enforce appropriate standards of conduct, and that it may at any time terminate my participation in the program for failure to maintain these standards or for any actions or conduct which the Program considers to be incompatible with the interests, harmony, comfort, and/or welfare of the Program and the other participants. If my participation is terminated, I consent to be returned to my home at my own (or responsible party's) expense with no refund of any fees.

2. Civil liability

I understand that as a Foreign Country citizen in China I will be subject to the laws of China. I acknowledge and understand that should I fall into legal problems with any foreign nationals or governmental jurisdictions of China, I will attend to the matter personally with my own personal funds.

3. Understanding and waiver of medical responsibility

I understand that there are certain risks inherent in international travel. I further understand that serious injuries occasionally occur during participation in travel, that participants in activities associated with travel occasionally sustain mortal or serious personal injuries, property damage, or severe economic and social loss as a consequences of not only their own actions or negligence but also the actions or negligence of others or the conditions of travel or equipment used and that there may be other risks not known to me or nor reasonably foreseeable at this time.

I understand that the Hutong Group Limited/Beijing Yanjing School and BTVU cannot assume responsibility for all or certain activities for me. I agree to release, waive, and discharge, their directors, staff and agents from all liability to me, my personal representative, assigns, heirs, and next of kin for any medical loss, damage, or injury caused solely by the negligence or wilful misconduct of the Hutong Group Limited/Beijing Yanjing School and BTVU, their directors, faculty, staff or agents.

4. Certification of good health
  
I am aware of my personal medical needs and hereby assure the Hutong Group Limited/Beijing Yanjing School and BTVU that I have consulted with a medical doctor as I may deem necessary with regards to any personal needs. I certify that to my knowledge I currently have no medical problem that would adversely affect my participation.

5. Medical responsibility and insurance

I am aware that, should I be required to be hospitalized while in China, the Hutong Group Limited/Beijing Yanjing School and BTVU can and do not assume any legal responsibility for payment of such costs. I hereby assure the Hutong Group Limited/Beijing Yanjing School and BTVU that I have assumed all risk and responsibility and that I have adequate medical insurance to meet any and all needs for payment of hospital costs or repatriation during the Beijing 2008 Summer Program including during travel segments.

I authorize the Hutong Group Limited/Beijing Yanjing School and BTVU and their agents at their discretion to place me at my own expense and without my further consent in a hospital for medical services and treatment, or if no hospital is readily available, to place me in the hands of a local medical doctor for treatment.

If deemed necessary or desirable by the Hutong Group Limited/Beijing Yanjing School and BTVU or its agents, I authorize them to transport me back to my country of origin by commercial airline or otherwise at my own expense for medical treatment. In the event the Hutong Group Limited/Beijing Yanjing School and BTVU or their agents advance or loan any monies to me or incur special expense on my behalf while I am abroad, I agree to make immediate repayment upon my return.

6. Passport and visa

I acknowledge that it is my personal responsibility to obtain all documents required for entering China or any foreign country or countries and that my failure to obtain these documents does not constitute grounds for withdrawal from the program with refund. I am responsible to attain all applicable visas and endorsements.
 
I understand that this agreement applies to my entire participation in the program including any excursions.

All references in the Agreement and Release to “the Hutong Group Limited”, "Beijing Yanjing School”, “BTVU” and "their agents" shall include the Hutong Group Limited/Beijing Yanjing School and BTVU and all of its officers, directors, staff members, campus directors, chaperones, group leaders, teachers, host school or school officials, employees, agents and affiliated companies.
